Terms of Use

1. Who we are

The mendai.tech website (the "Site") and the MendAI Diary app ("Diary") are provided by MendAI AS, organisation number 937 548 079, Terrasseveien 44B, 1363 Høvik, Bærum, Norway ("MendAI", "we", "us"). You can reach us at hello@mendai.tech.

2. What these terms cover

These terms apply when you use the Site or Diary. By using either, you agree to them. If you do not agree, please do not use them. How we handle personal data is described in our Privacy Policy.

3. Age

You must be 18 or older to use Diary or to contact us through the Site. By creating an account or sending the form, you confirm that you are.

4. Your Diary account

Give accurate details when you create your account and keep your sign-in secure. You are responsible for what happens on your account. You can delete your account at any time from inside the app; this deletes everything you wrote, as described in the Privacy Policy.

We may suspend or close an account that seriously or repeatedly breaks these terms. Where we reasonably can, we tell you first and give you the chance to put it right.

5. What Diary is, and is not

Diary is a private app for your diary, goals, health and accountability, with an AI that asks questions. You write in your own words; the AI asks questions and hands the thinking back to you. If you connect Apple Health or Health Connect, Diary shows that data alongside your days. It shows it as the source recorded it and never interprets or scores it.

Diary is not therapy, counselling, treatment or coaching, or a substitute for them. It does not diagnose, assess or predict any condition. Nothing in Diary or on the Site is medical, psychological, legal or financial advice, and nothing creates a professional relationship between you and MendAI. For those needs, please talk to a qualified professional.

6. Diary's AI

Diary's AI is not a person. Its replies are generated automatically. They can be inaccurate, incomplete or unsuitable for your situation, and they are not checked by a person before you see them. You decide what to do with them. Do not rely on the AI for decisions about your health, safety, money or legal position.

The AI only works after you agree in the app to send what you write to our AI provider, as described in the Privacy Policy. You can turn it off at any time.

7. Not an emergency or crisis service

Diary and the Site are not emergency or crisis services. If you are in immediate danger, or thinking about harming yourself or someone else, call your local emergency number now: 113 for a medical emergency in Norway, 112 from a mobile phone in South Africa and across the EU, 911 in the US and Canada, 999 in the UK. 8. What you write is yours

You own your entries, goals and everything else you write in Diary. You allow us to store and process it only to provide Diary to you, including sending it to the AI when you have agreed to that, and sharing the categories you choose with a therapist or facility you link to. We do not use it for anything else, we do not sell it, and we do not use it to train AI models. When you delete your account, it is deleted as described in the Privacy Policy.

9. Linking to a therapist or facility

You can link Diary to a therapist or counsellor who uses MendAI Companion, or to a facility that uses MendAI Platform, with a code they give you. Linking is always your choice and never a condition of care. You choose what is shared, one category at a time, and can stop at any time. This can include your entries and AI conversations, if you choose. What your therapist or facility does with what you share is their responsibility, as described in the Privacy Policy.

10. Contact form and feedback

If you ask for early access through the Site, we may contact you about it. Joining a waiting list does not guarantee access. If you send us feedback or ideas, you agree we may use them to improve our products without owing you payment or credit. Please do not send confidential information through the form.

11. Acceptable use

You agree not to:

• use the Site or Diary for anything unlawful, or to harm or harass others;
• probe, disrupt or overload our systems, or try to access systems or data not meant for you;
• copy, reverse engineer or decompile Diary, except where the law allows it;
• scrape or bulk-collect content from the Site beyond ordinary search-engine indexing that robots.txt permits;
• use the AI to produce unlawful content, or try to make it bypass its safeguards;
• misrepresent who you are when contacting us.

12. Licence and intellectual property

We give you a personal, non-transferable, non-exclusive licence to use Diary on Android or Apple devices you own or control (on Apple devices, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions), and to view the Site for personal, non-commercial use. The Site, Diary and their design, text, graphics, logos and code belong to MendAI or its licensors. The MendAI name and logo may not be used without our written permission.

13. Price

Diary is free and has no in-app purchases. If that ever changes, we will tell you in advance, and you will never be charged without agreeing to it first.

14. Changes and ending

We may improve, change or stop parts of the Site or Diary. If we stop offering Diary, we will give you reasonable notice first. If we change these terms in a way that matters to you, we will tell you in the app or by email before the change takes effect. You can stop using Diary and delete your account at any time.

15. Third-party links

The Site links to independent services, including crisis helplines. We do not control them and are not responsible for their content or availability.

16. Our responsibility to you

We provide the Site and Diary with reasonable care and skill, but we cannot promise they will always be available, uninterrupted or error-free. We are responsible for loss you suffer as a foreseeable result of our breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable, or for business losses. Nothing in these terms limits your rights as a consumer, or our liability where the law does not allow it to be limited, including for gross negligence, wilful misconduct, or death or personal injury caused by negligence.

17. Law and disputes

These terms are governed by Norwegian law, and disputes go to the Norwegian courts. If you live elsewhere, you keep the protection of the mandatory consumer laws of your country and can bring a claim in its courts. Please contact us first so we can try to resolve things. If you live in Norway, you can also ask Forbrukerrådet (the Norwegian Consumer Council) to mediate.

18. Apple App Store

If you downloaded Diary from Apple's App Store, the following also applies:

• These terms are between you and MendAI AS only, not Apple Inc. ("Apple"). MendAI AS, not Apple, is solely responsible for Diary and its content.
• Your licence to use Diary is limited to Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Diary may also be used by other accounts associated with you through Family Sharing or volume purchasing.
• MendAI AS is solely responsible for maintenance and support of Diary. Apple has no obligation to provide any maintenance or support for it.
• MendAI AS is responsible for any product warranties that the law does not allow to be excluded. If Diary fails to meet an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for Diary, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are MendAI AS's responsibility.
• MendAI AS, not Apple, is responsible for addressing any claims by you or any third party relating to Diary or your possession or use of it, including product liability claims, claims that Diary fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• If a third party claims that Diary or your possession and use of it infringes their intellectual property rights, MendAI AS, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
• Questions, complaints or claims about Diary go to MendAI AS, Terrasseveien 44B, 1363 Høvik, Bærum, Norway, hello@mendai.tech.
• You must comply with any applicable third-party terms when using Diary, such as your mobile network agreement.
• Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
